O2 Claim 4G Auction Terms Are “Illegal Under EU Law”

O2 has claimed that the way Ofcom is proposing to auction new 4G mobile services is “illegal under EU law”. A company spokesman added: “The spectrum floors would distort the auction process, allowing all bidders, except Vodafone and O2, to potentially acquire spectrum at discounted prices. Ofcom’s own figures suggest this effect could cost taxpayers £1bn.”
